1. DMCA Takedown Procedure (For Copyright Owners)

To submit a copyright infringement notice, send an email to copyright@upskrol.com containing the following information:

Required Information:

  1. Identification of copyrighted work: Describe the work you claim has been infringed (e.g., "My original song 'Title' released on [date]" or attach a copy)
  2. Identification of infringing material: Provide the specific URL(s) of the content on Upskrol that you believe infringes your copyright
  3. Your contact information: Full name, address, phone number, and email address
  4. Good faith statement: "I have a good faith belief that use of the material described above is not authorized by the copyright owner, its agent, or the law."
  5. Accuracy statement: "Under penalty of perjury, the information in this notice is accurate and I am the copyright owner or authorized to act on behalf of the owner."
  6. Signature: Your physical or electronic signature (typing your full name counts as signature)

⚠️ WARNING: Knowingly misrepresenting that material is infringing makes you liable for damages (including costs and attorneys' fees) under Section 512(f) of the DMCA. Only submit if you have a genuine copyright claim.

2. What Happens After You Submit a DMCA Notice

  1. We review your notice within 1-2 business days
  2. If valid, we remove the infringing content immediately
  3. The user who uploaded the content receives a copyright strike
  4. We notify the user of the takedown and provide them with your contact information (as required by law)
  5. The user has the right to file a counter-notification (see Section 4 below)

3. Three-Strike Repeat Infringer Policy

Upskrol maintains a strict repeat infringer policy. Users who receive copyright strikes face escalating consequences:

4. Counter-Notification Procedure (For Users Whose Content Was Removed)

If you believe your content was removed in error (e.g., you have permission, or your use qualifies as fair use), you may submit a counter-notification to copyright@upskrol.com containing:

Required Information:

  1. Identification of removed content: Describe the content removed and its location before removal (URL)
  2. Good faith statement: "Under penalty of perjury, I have a good faith belief that the content was removed as a result of mistake or misidentification."
  3. Your contact information: Full name, address, phone number, and email address
  4. Consent to jurisdiction: "I consent to the jurisdiction of the courts of the Netherlands."
  5. Signature: Your physical or electronic signature (typing your full name counts as signature)

Counter-Notification Timeline:

  1. We receive your valid counter-notification
  2. We forward it to the original claimant who filed the DMCA notice
  3. The original claimant has 10-14 business days to file a court action against you
  4. If they do not file a court action within that period, we may restore your content

5. Fair Use Protection

Upskrol respects the doctrine of fair use. Content that qualifies as fair use under Section 107 of the U.S. Copyright Act (or equivalent fair dealing laws) should not be removed. Examples of fair use include:

6. Repeat Infringer Account Termination

Upskrol terminates accounts of repeat infringers. A "repeat infringer" is defined as any user who:

If your account has been warned, suspended, or banned due to copyright strikes, you may appeal by emailing legal@upskrol.com with:
