1. Eligibility

Minimum age: 16 years old. You represent that you meet this requirement. Users under 18 must have parental consent.

Upskrol maintains a graduated enforcement system based on copyright strikes and policy violations:

3. Copyright Policy and Repeat Infringer Policy

Upskrol respects intellectual property rights and expects its users to do the same.

3.1 DMCA Compliance

We comply with the Digital Millennium Copyright Act (DMCA). To submit a copyright infringement notice, email our designated agent at copyright@upskrol.com with:

• Identification of the copyrighted work claimed to be infringed
• Identification of the material claimed to be infringing (URL or screenshot)
• Your contact information (name, address, email, phone)
• A statement of good faith belief that the use is not authorized
• A statement under penalty of perjury that your notice is accurate
• Your physical or electronic signature

3.2 Three-Strike Copyright Policy

• Strike 1: Warning issued. Your account status becomes "warned". Content removed.
• Strike 2: 30-day suspension. Your account status becomes "suspended". You cannot upload or comment during suspension.
• Strike 3: Permanent ban. Your account status becomes "banned" and you lose all access.

3.3 Counter-Notification (for users who believe content was wrongly removed)

If your content was removed due to a copyright claim, you may submit a counter-notification to copyright@upskrol.com with:

• Identification of the removed content
• A statement under penalty of perjury that you have a good faith belief the content was removed by mistake
• Your name, address, and email
• A statement consenting to jurisdiction in Amsterdam, Netherlands
• Your physical or electronic signature

Upon receiving a valid counter-notification, we will forward it to the original claimant. If they do not file a court action within 10-14 business days, we may restore the content.

4. Fair Use and Transformative Content

Upskrol supports freedom of expression and recognizes the legal doctrine of fair use/fair dealing.

4.1 What We Consider Fair Use

• Criticism and Commentary: Using short clips to critique, analyze, or comment on the original work
• Political Commentary: Using clips of public figures, politicians, or government proceedings for criticism or satire
• News Reporting: Using clips to report on current events
• Educational Use: Using clips for teaching or analysis
• Parody and Satire: Using clips to ridicule or mock public figures or works

4.2 What Is NOT Fair Use

• Re-uploading full movies, TV episodes, or music videos without transformation
• Uploading copyrighted music as background audio without permission
• Reposting another creator's content without significant commentary
• Using clips to replace watching the original work

4.3 Best Practices for Creators

• Use only the minimum amount of copyrighted material necessary to make your point
• Add substantial commentary, criticism, or analysis
• Your video should not serve as a replacement for the original work
• When in doubt, consider obtaining permission or using royalty-free content

5. Prohibited Content

The following content is strictly prohibited on Upskrol:

• Copyright Infringement: Unauthorized use of copyrighted material without transformative commentary
• Illegal Content: Child exploitation, terrorism, violence, or any illegal activity
• Hate Speech: Content attacking or discriminating against protected groups
• Harassment: Targeted abuse, bullying, or threats
• Sexual Content: Pornography, sexual exploitation, or non-consensual intimate images
• Spam: Repetitive, misleading, or deceptive content
• Impersonation: Pretending to be another person or entity

6. Content License

You retain ownership of your content. By uploading content to Upskrol, you grant us a non-exclusive, worldwide, royalty-free license to host, display, distribute, and promote your content on the Upskrol platform. This license ends when you delete your content or account, except for content shared by other users.

7. Account Termination and Suspension

Upskrol reserves the right to suspend or terminate accounts that violate these terms:

• Temporary Suspension: For second copyright strikes or serious policy violations (30 days)
• Permanent Ban: For third copyright strike, severe violations, or repeat offenses
• Content Removal: Individual videos or comments may be removed without full account action

8. Appeal Process

If your account has been warned, suspended, or banned, you may appeal by emailing legal@upskrol.com with:

• Your username and email address
• The action you are appealing (warning, suspension, or ban)
• The reason you believe the action was in error
• Any supporting evidence (licenses, permissions, fair use justification)

Appeals are reviewed within 14 business days. Decisions may be upheld, modified, or reversed at our discretion.

9. Moderation and Enforcement

Upskrol uses a combination of automated tools and human moderators to enforce these terms. We reserve the right to remove any content or suspend any account at our discretion.

10. Disclaimer of Warranties

The service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied. Upskrol does not warrant that the service will be uninterrupted, error-free, or secure.

11. Limitation of Liability

To the maximum extent permitted by Dutch law, Upskrol and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from your use of the service.

12. Governing Law and Jurisdiction

These terms are governed by the laws of the Netherlands. Any dispute arising from these terms or your use of Upskrol shall be subject to the exclusive jurisdiction of the courts of Amsterdam, Netherlands.

13. Changes to These Terms

We may modify these terms at any time. We will notify users of material changes via email or in-app notification. Continued use after changes constitutes acceptance of the new terms.
